Your privacy and the security of your personal information are very important to us and we are dedicated to protecting the privacy of those who visit our website(s). This Privacy Policy governs the United States websites operated by SlimGenics (collectively, "we", "us" or "our"), including, but not limited to, the websites located at www.slimgenics.com, community.slimgenics.com, homeprogramcommunity.com, www.Thermo-Boost.com, www.OrganicGourmet.com (collectively, our "Site") and our online products, including, but not limited to, chat rooms, message boards, social networking platforms, online community features, blogs, weight loss tools, e-coupons, newsletters, products, databases, including our products and offerings for personal digital assistants or other handheld or mobile devices (collectively, our "Handheld Products") and any of our other products, offerings, features, tools or resources that we provide on our Site and which may change from time to time (collectively, our “Online Products”). This Privacy Policy explains how we collect your personal information on our Site or through the Online Products, how we protect such information and the choices you have concerning the use of such information. We want you to be as comfortable as possible visiting our Site and using any of our Online Products, therefore, except as we disclose in this Privacy Policy, we will not sell, share, license, trade or rent your personal information to others.

We may amend this Privacy Policy from time to time. We will post any changes to this Privacy Policy on this webpage so that you will always know what information we gather, how we might use that information and under what circumstances, if any, we may disclose that information to anyone. Please refer back to this Privacy Policy on a regular basis. By using our Site or any of our Online Products, you agree to the terms of this Privacy Policy.

What information about me is collected on the Site or through the Online Products?
We collect two types of information: personally identifiable information and non-personally identifiable information.

Personally Identifiable Information
Personally identifiable information is information that identifies you or can be used to identify or contact you ("Personally Identifiable Information"). Such Personally Identifiable Information that we collect may include your name, address, email address, telephone number, birth date (primarily for eligibility purposes) and billing and credit card information. Further, in connection with some of our Online Products, we may request or collect from you information pertaining to your health, demographics, preferences and geographic location. We may request Personally Identifiable Information from you when you register on our Site, subscribe to or use our Online Products or in connection with other Online Products we may make available on our Site from time to time.

Unless you give us permission to do so, we will not sell, share, license, trade or rent your Personally Identifiable Information other than as specified in this Privacy Policy. You do not have to provide us with any Personally Identifiable Information to visit our Site. However, if you choose to withhold requested information, you may not be able to visit all sections of our Site or use all of our Online Products.

Non-Personally Identifiable Information
When you become a registered user of our Site, subscribe to or use our Online Products or in connection with other Online Products we may make available on our Site from time to time, we also may collect information that by itself typically cannot be used to identify or contact you, such as demographic information (such as age, profession or gender), health information (such as current weight and health history information) and in connection with our Handheld Products, geographic location information ("Non-Personally Identifiable Information"). Non-Personally Identifiable Information may also include user IP addresses, browser types, domain names and other anonymous statistical data involving the use of our Site. Non-Personally Identifiable Information is used to help us understand who uses our Site and to improve and market our Site and our Online Products. To the extent we are able to do so, we may associate and compile your Personally Identifiable Information with your Non-Personally Identifiable Information for purposes such as: analyzing trends, administering the Site, monitoring our Site's use, compiling general demographic information, gathering user preferences and information, personalizing your experience on our Site, evaluating our Online Products and marketing our services and products to you.

Like many other websites, we may use cookies to customize content specific to your interests and track your use of the Site. A “cookie” is a small file stored on the user's computer tied to information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on our Site. Cookies also measure usage of various pages on our Site to help us make our information more pertinent to your needs and easy for you to access and they provide functionality that we believe would be of interest and value to you. Cookies may also be used by a third-party service provider to display personalized targeted advertisements for you. Similarly, we may use “Web beacons” (also known as “action tags”, “tracer tags” or “single pixel gifs”) to help us better provide relevant products, services and information to you and to help us effectively measure advertising effectiveness. A Web beacon is a transparent image that has been placed on a Web page and sends a signal when a user has visited that page. A Web beacon does not contain any personal information. No information that is personally identifiable to you is transmitted to the third party using the Web beacon.

The Site uses Google Analytics (and in the future may use other similar sites or services), a web analytics service provided by Google, Inc. ("Google"), to better assist us in understanding how the Site is used. Google Analytics will place cookies on your computer that will generate information that we select about your use of the Site, including your computer's IP address. That information will be transmitted to and stored by Google. The information will be used for the purpose of evaluating consumer use of the Site, compiling reports on Site activity for our use and providing other services relating to Site activity and usage. Google may also transfer this information to third parties where required to do so by law or where such third parties process the information on Google's behalf. Log Files
We also collect Non-Personally Identifiable Information through our Internet log files, which record data such as user IP addresses, browser types, domain names and other anonymous statistical data involving the use of our Site. This information may be used to analyze trends, to administer the Site, to monitor our Site's use and to gather general demographic information. We may link this information to Personally Identifiable Information for these and other purposes such as personalizing your experience on our Site and evaluating our Online Products.

Information from Other Sources
We may also supplement the information we collect from you with information from other sources for purposes such as: assisting us in evaluating and improving our Site and Online Products, determining your preferences so that we can tailor our Site and Online Products to your needs, studying nutritional, weight loss, behavioral and fitness questions in general and to market our services and products to you.

Where and when is information collected on the Site or through our Online Products?
We may collect information (including information that is Personally Identifiable Information) from you in different manners and at different places and times on our Site, such as when you register for our Site or subscribe to or use our Online Products. We also may collect information from you in connection with or through, other Online Products we may make available on our Site from time to time. The following is a description of the areas and/or manners in which we primarily collect information about you:

  • 1. Becoming a Registered User and Creating an Account
    In order to access certain Online Products on our Site, such as our chat rooms, message boards, blogs, weight loss tools, e-coupons, newsletters, databases, social media platforms, bulletin board services, chat areas, forums or other message and communications features you must first complete certain steps to become either a registered user or a subscriber. During these steps, you may be required to provide us with information (including Personally Identifiable Information) such as name, zip code, email address, physical address, date of birth, health information and preferences and if you subscribe to one of our Online Products, credit card and billing information. This information is used to help us understand who uses our Site, to improve our Site and our Online Products, to contact users about requested Online Products and/or for subscription billing purposes. It is optional for you to provide certain information (such as profession and number of children), but providing the requested information is encouraged so we can provide a more personalized experience on our Site.
  • 2. Use of Online Products
    We provide (or may provide in the future) multiple community areas (including, without limitation, chat rooms, message boards, social networking platforms, online community features, blogs, including our Handheld Products) and other public forums where users with similar interests can share information and support one another or where users can post questions for others to answer. Our communities are for the use of SlimGenics clients only.

    Any information you share in any online community area (including Personally Identifiable Information and personal health information) like a chat room or online discussion is by design accessible to other SlimGenics clients and is not private. You should think carefully before posting any Personally Identifiable Information or personal health information in any public forum. What you post can be seen, disclosed to or collected by third parties and may be used by others in ways we cannot control or predict, including to contact you for unauthorized purposes. As a result, the information you post may also show up in third-party search engines like Google, Yahoo, MSN, Bing etc.

  • 3. Email or Refer a Friend
    Through our referral tools for informing a friend about our Site or one of our Online Products, we will automatically send your friend an email containing the information you request to be sent. If you elect to use these referral tools, we will collect from you certain Personally Identifiable Information about your friend that you have provided, such as your friend's name, email address and preferences.

License to Use Your Information and Material By posting on the Site or sending SlimGenics any information or material, you grant SlimGenics an unrestricted, irrevocable license to use, reproduce, display, perform, modify, transmit and distribute those materials or information and you also agree that SlimGenics is free to use any ideas, concepts, know-how or techniques that you send us for any purpose. However, we will not release your name or otherwise publicize the fact that you submitted materials or other information to us unless: (a) we obtain your permission to use your name; or (b) we first notify you that the materials or other information you submit to a particular part of this site will be published or otherwise used with your name on it; or (c) we believe in good faith that we are required to do so in order to comply with an applicable statute, regulation, rule or law, a subpoena, a search warrant, a court or regulatory order or other valid legal process.

Do we collect information from children under 13 years of age?
We are committed to protecting the privacy of children. Our Site and Online Products are not designed for or directed to children under the age of 13. We do not collect Personally Identifiable Information from any person we actually know is under the age of 13. We urge all parents or guardians to participate in their children's exploration of the Internet and to teach their children about protecting their personal information while online.

What do we do with the information we collect?
In general, we use the information collected on our Site and through our Online Products to help us understand who uses our Site and Online Products and how they are used, to personalize your experience, to assist you in using our Online Products and achieving your goals through the SlimGenics program, to improve our Site and Online Products and for client billing purposes, if applicable. (With respect to our Handheld Products, for example, we may use such information, among other things, to ensure that your handheld device is supported, that it has sufficient memory available for the application, to confirm which versions of the application's files are installed on your device and to identify your locations of use for the Handheld Products.)

If you become a registered user of our Site or subscribe to one of our Online Products, we may use your information to send you a welcoming email that may confirm your user name and password. If you "opt-in," we may send you electronic communications, contact you about SlimGenics products, services, information and news that may be of interest to you and provide you with targeted feedback. Further, we may contact you with offers and/or promotions for SlimGenics and for select, reputable third parties with whom SlimGenics has a strategic marketing relationship because they offer products or services that we believe would be of interest to you. If you no longer desire to receive these marketing communications, we will provide you with an option to change your preferences. In addition, if you identify yourself to us by sending us an email with questions or comments, we may use your information (including Personally Identifiable Information) to respond to your questions or comments and we may file your questions or comments for future reference. We may also use the information collected to send you important service announcements and updates regarding our Site or Online Products or, if you are a client, about your billing account or account status. You will not be able to unsubscribe from these communications as they contain important information relevant to your use of our Site and/or our Online Products. In addition, if you become a SlimGenics client, registered user or subscribe to one of our Online Products we may use your information to contact you by postal mail about SlimGenics products, services, information and news and offers and/or promotions of select, reputable third parties with whom SlimGenics has a strategic marketing relationship because we believe such communications would be of interest to you, unless you notify us that you no longer desire to receive these communications.

We may also use the information gathered on our Site and through our Online Products to perform statistical analysis of user behavior, to analyze and evaluate issues relating to nutrition, weight loss, behavior, fitness and preferences or to evaluate and improve our Online Products. We may link some of this information to Personally Identifiable Information.

When do we disclose information to third parties?
Except as set forth in this Privacy Policy or as specifically agreed to by you, we will not disclose any information we gather from you on our Site. We may disclose information to:

  • 1. Provide You With Requested Goods and/or Services
    We may disclose information (including Personally Identifiable Information) in situations where sharing or disclosing your information is required in order to offer you products or services you desire or have requested.
  • 2. Our Affiliates
    We may disclose information (including Personally Identifiable Information) about you to our Affiliates. For purposes of this Privacy Policy, "Affiliates," means any person or entity which directly or indirectly controls, is controlled by or is under common control with SlimGenics whether by ownership or otherwise or any franchisees or licensees of SlimGenics. Any information relating to you that we provide to our Affiliates will be treated by those Affiliates in accordance with the terms of this Privacy Policy.
  • 3. Comply With Laws or Enforce Legal Rights
    We may also disclose your information (including Personally Identifiable Information) if we believe in good faith that we are required to do so in order to comply with an applicable statute, regulation, rule or law, a subpoena, a search warrant, a court or regulatory order or other valid legal process. We may disclose Personally Identifiable Information in special circumstances when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating our Terms of Service or this Privacy Policy or another agreement, to protect or defend our rights or property, to protect the safety and/or security of our users, our Site or the general public or in any other situation in which we deem such disclosure prudent.
  • 4. Third Parties Generally
    We may share your personal information with select third parties who offer goods or services we think may be of interest to you. From time to time, we may partner with other companies or organizations to provide co-sponsored or co-branded promotions, services or events and may share your personal information with our co-sponsors or partners. Further, we may provide to third parties information about you that does not allow you to be identified or contacted, including where such information is combined with similar information of other users of our Site. For example, we might inform third parties regarding the number of unique users who visit our Site, the demographic breakdown of the registered users of our Site or the activities that visitors to our Site engage in while on our Site.     We may employ independent contractors, vendors and suppliers (collectively, "Outside Contractors") to provide specific services and products related to our Site or Online Products, such as hosting and maintaining our chat rooms, providing credit card processing and fraud screening and developing applications for our Site and email services. These Outside Contractors may sometimes have limited access to information collected on our Site, including your Personally Identifiable Information, in the course of providing products or services to us. We may also share your Personally Identifiable Information or Non-Personally Identifiable Information with third-party ad servers for their use in providing targeted advertisements or performing their contractual obligations to us. Access to your Personally Identifiable Information by these contractors is limited to the information reasonably necessary in order for the Outside Contractors to perform their limited function for us. We also require that these contractors (i) protect the privacy of your Personally Identifiable Information consistent with this Privacy Policy and (ii) not use or disclose your Personally Identifiable Information for any purpose other than providing us with products or services for which we contracted.
  • 6. Effectuate a Sale of Business
    We reserve the right to transfer information to a third party in the event of a sale of assets, bankruptcy or the sale of all or part of SlimGenics’ business or any other corporate change or re-organization.

Information Sharing Disclosure Requests
If you are a California resident, you have the right to request one Notice of Information-Sharing Disclosure per year which will identify the third parties with whom SlimGenics or any of our Affiliates has shared the Personally Identifiable Information we have collected from you. We will respond to your request for a Notice of Information-Sharing Disclosure within 30 days of receiving your request.

Does this privacy policy apply when I link to other websites?
Our Site may contain links to other websites not owned or operated by SlimGenics. We will attempt to make it obvious to you when you leave our Site and enter these websites by opening a new browser or otherwise notifying you that you are leaving our Site. However, please be aware that we are not responsible for the privacy practices of such websites. We encourage you to be aware when our Site links to other websites and to read the privacy policies or statements of each and every website. This Privacy Policy applies solely to information collected by our Site.

Is the information we collect secure?
We want your information (including Personally Identifiable Information) to remain as secure as possible. We strive to provide secure transmission of your information from your computer to our servers through commercially reasonable industry-standard techniques. We secure the Personally Identifiable Information you provide on servers located in controlled, secure environments, reasonably protected from unauthorized access, use or alteration. Only employees or other persons who need access to your information to perform a specific task or function are authorized access to such information. In addition, all SlimGenics employees must abide by this Privacy Policy and SlimGenics makes reasonable efforts to ensure employees are kept up-to-date on security practices applicable to the employees’ respective job responsibilities. Any employee who violates this Privacy Policy is subject to disciplinary action, up to and including termination.

Notwithstanding the above commitments to protect your information (including Personally Identifiable Information) from loss, misuse or alteration by third parties, you should be aware that there is always some risk involved in transmitting information over the Internet. There is also some risk that others could find a way to thwart our security systems. As a result, while we strive to protect your information, we cannot ensure or warrant the security and privacy of any information you transmit to us and you do so at your own risk.

How will I know if there are any changes to this Privacy Policy?
If we decide to change this Privacy Policy, we will post those changes on this webpage so you are always aware of what information we collect, how we use it and under what circumstances, if any, we may disclose it. If at any point we decide to use your Personally Identifiable Information in a manner materially different from that stated in this Privacy Policy or otherwise disclosed to you, at the time it was collected, we will notify you by email or otherwise and you will have a choice as to whether or not we use your Personally Identifiable Information in the new manner. Display of advertising and opt-out
From time to time we may use a third-party service provider (“Provider”), to serve advertisements on our behalf across the Internet and sometimes on this Site. When a Provider displays online advertisements to you, it will place one or more “cookies,” pixel tags and/or other similar mechanisms on your computer in order to recognize your computer each time it displays an ad to you. While the Provider may use some of the information it collects in order to personalize the ads it shows you, it designed its system to select ads only on the basis of data that does not personally and directly identify you.
